Privacy Policy

The short version. I'm a one-person agency based in Nanaimo, BC. I collect the bare minimum, I don't sell anything to anyone, and if you want your information deleted, email me and I'll delete it, unless the law says I have to keep it.
Who this is about
Northpoint Digital Agency, a British Columbia sole proprietorship of Kyle Nielsen (registration FM1115768). Contact: northpointdigitalagencys@gmail.com or (778) 268-3721.
I am the person responsible for how personal information is handled here. This policy follows British Columbia's Personal Information Protection Act (PIPA) and, where it applies, Canada's Personal Information Protection and Electronic Documents Act (PIPEDA).
What I collect
- If you email or call me: your name, email address, phone number, and whatever you choose to tell me about your business.
- If you fill in the form on this site: your name, phone number, business name, town, and your message. The form is handled by Netlify, the company that hosts this website. A copy of your message is stored in my Netlify account and emailed to my business inbox. Netlify may also record the IP address and browser the form was sent from, to filter out spam.
- If you ask for a free website check: your website address, your email address, and your name if you give it. I use them to run the check, email you the report, answer your questions about it, and follow up once. The form is handled by Netlify, the same way as the form above.
- If you book a call: the details you enter into the booking page, which is run by Google Calendar.
- This website does not run analytics, advertising pixels, or tracking of any kind, and it does not set cookies for tracking or advertising. Fonts and images load from this website itself. My host, Netlify, processes visitors' IP addresses to deliver the site and keeps standard server logs, as every web host does. I do not use any of this to identify anybody.
Why I collect it
Only to reply to you, to quote work, and to deliver services you have asked for. Nothing else.
If you send me an enquiry, I will reply about it and may follow up for up to six months. You can tell me to stop at any time.
What I never do
- I do not sell, rent, or trade your information.
- I do not add you to a mailing list without you asking.
- I do not share your information with anyone except a service I need to do the work (for example Google or Meta when running your advertising), and only what is necessary, or when the law requires it (for example a court order).
Where your information is kept
Your information is held in my Google account (Gmail and Google Calendar), and in my Netlify account when you use the form. These companies may store or process it outside Canada, including in the United States, where it can be accessed by the courts, law enforcement and national security authorities of that country. I only use services I need to do the work.
Clients
If I run advertising for you, the enquiries those ads bring in belong to you, and they are delivered to you. You are responsible for how you then contact and store those people's details, including your own obligations under Canada's privacy and anti-spam laws.
If I build your website, the enquiries its contact form collects are sent to you, and you need your own privacy policy on your site. I can help you set that up.
Cold outreach
If I have emailed you without you contacting me first, it is because your business email was publicly listed without a request not to be contacted, and the message related to your business, which is the basis permitted under Canada's Anti-Spam Legislation. Reply with "unsubscribe" and I will remove you immediately and permanently.
How long I keep it
Enquiries that go nowhere are deleted within twelve months. If I used your information to make a decision about you, such as a quote, I keep it for at least one year after that decision, as BC law requires. Client records are kept for six years after the end of the tax year they relate to, as the Canada Revenue Agency requires, then deleted.
Your rights
Under BC's PIPA and, where it applies, PIPEDA, you can ask me in writing what I hold about you, how it has been used and who it has been shared with, and ask me to correct it or delete it. I aim to reply within a day or two, and always within 30 business days. You can withdraw your consent at any time; the only consequence is that I may not be able to help with what you asked for.

Security
Your information sits in password-protected accounts with two-step verification turned on. No system is perfect, so I don't keep anything I don't need. If something ever went wrong that put your information at risk, I would tell you.
Changes
If this policy changes, the date at the top changes with it.
